  1. Introduction:
    Welcome to KOSH MALL. Below are the Terms and Conditions governing your use of our website and services.

  2. Definitions:
    KOSH MALL: Refers to the electronic commerce website operated under this name.
    Username: Refers to any KOSH MALL user or any individual benefiting from KOSH MALL services.

  3. Price:
    Product prices are displayed directly. In case of a sale or special offer, the discount rate will be shown. KOSH MALL reserves the right to change prices at any time without prior notice. KOSH MALL is not responsible for any difference between website prices and prices of similar products in local or international stores.

  4. Currency:
    All prices are based on the Sudanese Pound (SDG). If prices are requested in another currency, KOSH MALL will convert them using the weekly average market exchange rates to ensure accuracy.

  5. Payment:
    You are responsible for all amounts due for products ordered through your account. If payments are not received from your credit card issuer, agent, or bank, you agree to settle all outstanding amounts. You are responsible for any costs associated with overdue payments.

  6. Credit Cards:
    We accept Visa and MasterCard and use PayPal as a secure payment gateway. You will be asked to provide card details (cardholder name, number, expiration date, and security code).
    • We obtain authorization for the transaction amount during order placement.
    • Amounts are collected only after the order is completed and shipped.
    All orders are reviewed to prevent fraud or unauthorized activity. KOSH MALL may refuse orders, cancel accounts, or decline shipping if fraudulent activity is suspected.
    Ensure the authenticity of the company name and documents on our platform before proceeding to external payment gateways.

  7. Agreement:
    Adding items to the cart without completing the purchase does not constitute a sale agreement. KOSH MALL is not responsible if items become unavailable before checkout.
    A sale agreement is formed only when:

  1. Authorization is received from the credit card issuer.

  2. Bank transfer appears in the KOSH MALL account within 3 business days.

  3. Direct deposit appears in the KOSH MALL account within 3 business days.
    KOSH MALL may refuse or cancel orders without providing reasons. Its responsibility is limited to refunding received payments.
    If pricing errors occur, KOSH MALL is not obligated to sell products at incorrect prices and will issue refunds.

  1. Taxes and Import Duties:
    Orders may be subject to customs duties and taxes upon arrival in your country. KOSH MALL does not collect these charges and cannot predict them. Customers must pay all customs fees to release the shipment.
    Shipping fees (outside PRE-SELECTED COUNTRY FOR ORDER) include: freight + 6% fuel surcharge + 10% mailing tax + 5% import fee (variable by country).

  2. Terms and Conditions of Supply:
    KOSH MALL ships via various courier companies.
    • Delivery inside PRE-SELECTED COUNTRY FOR ORDER: approx. 2 days.
    • Delivery outside: 7–10 working days, potentially up to 2 weeks during high seasons or customs delays.
    Shipping cost is calculated per product unless combined shipping applies.
    Orders placed before 2 PM are processed the same day; after 2 PM are processed next business day. Orders placed on Fridays are processed Saturday morning.

  3. Undelivered and Out-of-Stock Orders:
    Items may be out of stock or pending supplier confirmation. If shipping cannot be processed within 30 days, you will be notified. If the product becomes unavailable, the order will be canceled.
    Your credit card will not be charged until the product is shipped.

  4. Disclaimer:
    Some products (e.g., perfumes) may not be shipped to certain countries due to safety restrictions.
    Website interruptions may occur due to maintenance or technical issues. KOSH MALL does not guarantee uninterrupted service or freedom from viruses, bugs, or data loss.

  5. Special Offers:
    KOSH MALL is not responsible for price differences if the customer does not complete their purchase during the promotional period.
    Incorrect or damaged products will be replaced at KOSH MALL’s expense. If the product is not part of a special offer, replacement is not guaranteed and a refund will be issued minus delivery costs.

  6. Product Orders:
    Product availability and prices are subject to change without notice.
    If a product is listed at an incorrect price due to typographical or supplier error, KOSH MALL may cancel the order—even if confirmed—and issue a refund.

  7. Reviews:
    KOSH MALL may modify or discontinue any part of the website at any time without notice. Continued use of the site after updates means acceptance of changes.

  8. Disputes:
    Any dispute not resolved through customer service will be referred to confidential arbitration under Sudanese law. Arbitration procedures shall take place in Sudan.

  9. Period and Cancellation:
    This agreement becomes effective upon registration and continues until terminated by the user or authorized KOSH MALL personnel.

  10. Copyright:
    All site contents—including themes, graphics, logos, icons, images, audio, and software—are owned by KOSH MALL and LAGHAWEES Trading and Services. Reproduction, distribution, or re-publication without written permission is prohibited.
    Users are encouraged to report any illegal or offensive content.

  11. Responsibility of Using the Website:
    Users acknowledge that KOSH MALL is not responsible for any violations of this agreement.
    Claims related to warranties must be addressed to the supplier.
    KOSH MALL does not guarantee the accuracy or completeness of product descriptions, prices, or content.
    Users should not rely on information in cases where accuracy is critical.

  12. Brands and Logos:
    Marks, logos, and icons belonging to KOSH MALL must not be used for unauthorized purposes or in any way that causes confusion or harm to the brand.

  13. Copyrights:
    All content and data—including software, databases, graphics, and designs—are owned or licensed by KOSH MALL and protected under international copyright laws.

  14. Account Registration:
    To purchase products, you must create an account and provide accurate information.
    You confirm that you:
    • Are at least 18 years old.
    • Are using your real identity.
    • Provide complete and accurate data.
    You are responsible for maintaining the confidentiality of your account and passwords. KOSH MALL is not responsible for losses resulting from misuse of account credentials.
    You may request account cancellation at any time. KOSH MALL reserves the right to modify website terms without prior notice.

  15. Order Terms:
    KOSH MALL may cancel memberships that violate registration conditions.
    Orders must be fully prepaid unless Cash on Delivery is available.
    Payment information must match the recipient's name.
    Shipping address must be accurate.
    Orders shipped as gifts must be prepaid.
    Electronic warranties depend on the manufacturer unless otherwise stated.
    Coupons may be canceled without notice.
    Violation of conditions may result in legal action.

  16. Order Cancellation or Amendment:
    Orders may be canceled or modified unless already shipped. Administrative fees apply (10 AED or 5%, whichever is higher).
    Imported products may not be canceled after shipment from the source.
    Refunds will be issued after deducting applicable bank fees and customer’s local charges.

  17. KOSH MALL Protection:
    Users must report violations or infringements immediately.
    KOSH MALL may suspend or terminate accounts involved in harmful activities.
    Unauthorized links or content are prohibited.
    Users agree to indemnify KOSH MALL and its staff against damages resulting from misuse or breach of terms.

  18. Dissemination of Feedback:
    User feedback may be displayed on the website and may help other customers evaluate products. By submitting feedback, you agree to its publication along with your username.
